@piya84
why would the women fail to report their rape if ultimately it will gift death sentence to the rapist?? and if you must know, this inquiry and reporting is done very secretly wherein the women's identity is not published. its not like in india where you see each and every rape case being explained in detail in papers as if its some sort of masala to the readers! here also ultimately the girl reports to the hospital & never can hide it.

The first two words of the title of this post are Sharia Law. With that in mind I dont think that any input so far is off topic and as a result I certainly wont be deleting a thing from this post
Debate is healthy and such subject matter is bound to bring about debate about many aspects of Sharia Law and Islam and all the input on this post is relevant
I do still await input though on my thoughts on Hadith Al-Tirmidhi in the Book of Sunah.
I would welcome thoughts on what the Prophet Muhammad (P.B.U.H.) decreed and how it contradicts the very foundations of Islamic/Sharia Family Law,
I know we are no longer married when we are dead, but even after we pass from this life it seems that women still get a raw deal in the afterlife.
Well?

@jimbo
nice to hear that we still havent got off topic. yes everything we have discussed so far has been concerned with sharia laws in one way or the other. regarding your hadith, i didnt quite understand which hadith of the prophet you are referring to. are you referring to the hadith which says the prophet saw more women than men in hell? if possible could you please give the reference or a link to where its shown.

No, I am referring to the Hadith which tells the martyr of what awaits in Heaven.

The smallest reward each for the people of Heaven is an abode where there are 80,000 servants and 72 wives, over which stands a dome decorated with pearls, aquamarine and ruby, as wide as the distance from Damascus to Yemen.

It was a Hadith which allegedly was written to stop the martyrs doing bad sexual things when they were alive, hence the promise of all the virgins in heaven, and this included young boys as well.

Like most holy books, the contents can be interpreted in many ways, and I have heard Muslims acknowledge this is correct whilst others claim it to be hoax.

Have a look at (56:17-24)

i dont find anything that degrades the women there. i mean which young man wouldnt prefer young virgin ladies. so Allah is reminding us that if we lead a sin less life in this world and stay from illegal sexual intercourse, you will get all those things. this can also serve as an inspiration to strive in the way of God in this life. ticks why its mentioned like that in chapter 15.

@nonstopthinker First thing to prove rape has happened religious courts demand eyewitness which in many cases is impossible to get.Rapist people are not dumb to do these acts openly in front of other people.If victim that is women fails to prove it was a rape they punish her for adulatory.This is the big reason why women there are scare to report it.
other things about looking down on her by people and problems regarding marriage i have mention in my earlier post.

You and I will have to differ on this, as I have a very different take on what The Prophet Muhammad (p.b.u.h) meant.

@piya
i would suggest you to please back your answers with logical thinking and research. do you think islamic courts have fools sitting on the judge's chair? in islamic rule the rape victim should be examined medically and the process of jurisdiction is complex and secure (too long to explain here-i will if you want in several threads) there is no question of inhuman treatment of the girl. no adultery case against girl if not found guilty.

@piya
ok. i read. here also you have not clearly understood the case because your knowledge of sharia law seems limited. firstly, islamic law states that no one involved in the case shoul approach the media unless the case is fully settled and all sides are heard. the girl here spoke before verdict. this islamic law ensures that such cases are not sensationalised(like in india) which may hurt maybe an innocent convict and affect the trial incourt

But you have missed a point nonstopthinker

Victim has been punished for 90 lashes because it was illigal mingling[???].
This is the reason women dont go to court for justice.

this news was originally brought out by cnn news. i wonder how much success they have got in invoking against islam even when there are plenty of women torturing unsolved rape cases in their country us.
about your question, the women when she was on trial was convicted for another charge in another pending case where in the result came that she really did illegal mingling and sexually tried to lure someone. that was however omitted by cnn.

however i am not speaking completely in support of saudi arabia also. there are wrong things also in saudi arabia where they are deviating from islamic law. but wherever they have implemented islamic sharia law they have got very good results and that sets the example.

She wasnt mingling with that man.They were exchanging photos in their car.Whatever it is.90 lashes for sitting in a car with someone other than husband is barbaric.
I just wanted to prove my point why women there are scare to go to court to demand justice.This is the reason very less cases of rape and abuse get reported.

@piya
exchanging girls photo with another man while she is wed is prohibited in islam. however i dont wish to go more into islamic laws because you will call them also barbaric because you are viewing them from an anti islamic stand point but i assure you once you open your mind and undertand why its there (not how people practice it or implement it in certain cases) you will agree that there is logic in these laws.
